The general terms and conditions of sale detailed below apply to all orders placed with Arsène et les Pipelettes for all items and services offered on the Arsène et les Pipelettes site, unless otherwise agreed in writing. The present general terms and conditions of sale are systematically proposed to you when you place an order.
Consequently, the fact of placing an order implies your full adhesion, without reserve, to these conditions.
Arsène et les Pipelettes reserves the right to modify the present general conditions of sale at any time. Nevertheless, the General Terms and Conditions of Sale applicable to your order on the Arsène et les Pipelettes website are those accepted by you at the time you place your order.
1. Order taking
As a customer of the company Arsène et les Pipelettes, you declare to have the capacity to contract under the conditions described below, i.e. to be an emancipated minor or to have the legal majority and not to be protected within the meaning of article 488 of the Civil code.
Arsène et les Pipelettes reserves the right to refuse any Order from a Customer with whom a dispute exists or appears during the processing of an Order, in particular a payment dispute.
1. Your basket constitutes your Order form.
2. If you choose to place an Order, you will have to enter the necessary information for invoicing and delivery. The information that you will then deliver is binding. In the event of an error in the wording of the delivery information, the site and the company Arsène et les Pipelettes shall not be held responsible for the impossibility of delivering the item(s).
3. After validation of your coordinates, you will choose your means of payment. Your order will be automatically validated and will constitute an irrevocable commitment on your part which can only be called into question in the cases restrictively provided for by the present conditions (see your right of retraction).
Any order is deemed firm and can only be cancelled with the consent of Arsène et les Pipelettes and under conditions that will compensate it for any prejudice or damage caused by this cancellation.
2. Confirmation of order
At each stage of the processing of your order (validation, possible change of availability, shipping) an email is sent to you provided that the email address indicated in your registration form does not contain any errors. The email confirming the processing of your order and the sending of your package will specify the number of the package.
Arsène et les Pipelettes reserves the possibility of not confirming an order for any reason whatsoever (problem concerning the order received or problem with the supply of items). Arsène et les Pipelettes has 15 working days to inform you that it cannot satisfy the order and to ask you to modify or cancel it.
3. Follow-up of order
You can check the status of your order at any time by visiting the "My Account" section on the www.arseneetlespipelettes.com website. This tracking allows you to know the processing status of your order and then to follow the status of the shipment thanks to the parcel number that will appear in the status of your order.
4. Information on the products
Product features
The information, characteristics, photographs and graphics presented on the sites or in the emails sent by Arsène et les Pipelettes are given for information purposes only. In particular, Arsène et les Pipelettes cannot be held liable for any difference in the perception of shapes and colors between the photographs or graphics presented and the products. Arsène et les Pipelettes will make its best efforts to ensure that the photographic representation of the products on the site www.arseneetlespipelettes.com is as faithful as possible. It is nevertheless possible that the perception of the product(s) may not correspond completely to the products. The products are presented in photography sometimes with other products. The description will mention what is or is not part of the product.
Availability of products
Arsène et les Pipelettes undertakes to honor orders received only within the limit of available product stocks. In the absence of availability of the Product(s), Arsène et les Pipelettes undertakes to inform you as soon as possible.
Availability may vary within the same day depending on the level of sales. Arsène et les Pipelettes updates availability very frequently, but cannot be held liable if the stock is no longer the same as that indicated.
Arsène et les Pipelettes shall not be held liable for non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or all-out or partial strike, in particular of the postal services and means of transport and/or communications, flood, fire.
Price
The prices are indicated in euros all taxes included. However, they may be modified at any time in the event of special conditions linked to certain economic factors, duties and taxes, changes in the cost of labour or raw materials, your particular requirements.
The applicable prices are those displayed on the site at the time of validation of the order.
All prices are indicated in euros and do not include shipping costs which will be automatically calculated and indicated on your order form (your basket).
For deliveries within the European Union, prices are inclusive of value added tax at the current French rate (19.6%), and for export sales, prices are FOB from Ciboure. The customs clearance, payment of various duties or taxes are at your expense.
All goods sold travel at your own risk, whatever the mode of transport.
5. Payment
The payment of the totality of the price is due with the order. It can be made :
- by credit card. We accept credit cards, Visa and Mastercard. We recommend this option because it is the simplest, fastest and completely secure.
- by Paypal, Arsène et les Pipelettes has opted for a highly secure payment tool, fully guaranteed by Paypal. This label of quality ensures you a total security of the payment of your online purchases.
The order is taken into account with the payment which is stipulated irrevocable, cash, net and without discount. Any delay, incident or failure to pay entails, as a penalty, late payment interest equal to one and a half times the legal interest rate pursuant to Law No. 2001-420 of 15/05/2001 Article 53 II published in the Official Journal of 16/05/2001.
The company Arsène et les Pipelettes reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card by the officially accredited organizations or in case of non-payment. In particular, Arsène et les Pipelettes reserves the right to refuse to make a delivery or to honor an order from a Customer who has not fully paid for a previous order or with whom a payment dispute is in progress.
6. Zones and delivery times
We deliver your items wherever you want. If you want to be delivered to a friend's house, a neighbor's house, to your workplace... Just specify it when you order.
The delivery time indicated on your order form (in your shopping cart) is the average time required to send your items to your chosen destination and does not take into account the processing time of your order. Count approximately 72 hours for the processing of your order, then 2 days for a delivery in France and 5 days for a delivery in Europe.
Arsène et les Pipelettes has chosen the Colissimo Suivi offer of La Poste for the delivery of your orders.
We remind you that it is your responsibility to inspect your parcels upon receipt in the presence of the deliveryman before signing the delivery note and to notify any anomaly (shock, open package, damage to the package, delivery date not conforming to the normal delivery service deadlines...) to the carrier, as well as to Arsène et les Pipelettes, within 24 hours. In the event that such mentions were not made on the delivery slip presented by the carrier, no claim relating to the condition of the package(s) could be accepted a posteriori by Arsène et les Pipelettes.
If you or the recipient of the parcel is absent at the time of delivery, a delivery notice will be left indicating where and when to collect the parcel.
In the event of a significant delay in delivery, we undertake to compensate you by offering you delivery charges on your next order. However, delivery time overruns may not give rise to damages or interest, nor to withholding or cancellation of orders in progress, in the event of total or partial strikes, internal or external to the company, blockage of means of transport or supply, government or legal restrictions.... The Arsene et les Pipelettes site could not be held responsible if laws, regulations or any other event would lead to a detention of your articles at the borders.
7. Invoice
The order form that you establish online or the order confirmation that Arsène et les Pipelettes has sent you by e-mail does not serve as an invoice. You have the original invoice in your online account. The invoice is attached to the parcel.
Arsène et les Pipelettes keeps an electronic copy of each invoice.
In the case of a delivery to an address different from the billing address, the invoice is in any case only available in the online tracking of your orders.
8. Transfer of Ownership
Arsene et les Pipelettes remains the owner of the Products delivered until full payment is received. The above provisions do not prevent, upon delivery of the Products, the transfer to you of the risks of loss or deterioration of the Products subject to retention of title as well as any damage they may cause.
9. Right of retraction
In the context of distance selling (without the simultaneous physical presence of the parties), you have, according to Article L 121-20 of the French Consumer Code, a period of fifteen (15) clear days to exercise your right of withdrawal without having to justify the reasons or pay penalties, except for the cost of return. The above time limit runs from receipt for goods or acceptance of the offer for services.
You may then return the items to us at your expense in their original packaging. You can choose between a refund of the purchase (excluding shipping costs) or an exchange with another item from the store.
The exchange or refund of the items in your order will be made only after verification by our Customer Service of the quantity and quality of the items returned to us. The items must not have been used, nor have suffered any deterioration, however slight, and must be in a perfectly clean condition.
This right of retraction is therefore exercised without penalty, except for the cost of return and new delivery charges.
Dispute
Complaints or disputes will always be received with attentive benevolence. In the event of litigation, you will address yourselves to the company Arsène et les Pipelettes to obtain an amicable solution, by mail: Arsène et les Pipelettes - 28, rue Aristide Bourousse - 64500 Ciboure - FRANCE or by e-mail to: [email protected].
Failing this, and subject to the customer's status as a "trader", any litigation relating to the interpretation or execution of these general terms and conditions will be under the exclusive competence of the Commercial Court of Bayonne.

We guarantee the confidentiality of the personal information entered.
In accordance with the French law "Information et libertés" n°78-17 of January 6, 1978, you have the right to access and rectify data concerning you. 11. Intellectual property
All elements of the Arsène and Pipelettes site, whether visual or sound, including the underlying technology, are thus protected by copyright, trademarks and patents. They are the exclusive property of the company Arsène et les Pipelettes.
Any user who has a personal Internet site and who wishes to place, for personal use, on his site a simple link referring directly to the home page of the Arsène et les Pipelettes site must request authorization from Arsène et les Pipelettes. In all cases, any link, even tacitly authorized, must be removed upon simple request from Arsène et les Pipelettes.
Consequently, the partial or total reproduction on any support whatsoever of the elements composing the site, their use and their availability to third parties are formally prohibited and will systematically be prosecuted.

How does it work? Payment by credit card in 3 or 4 instalments enables you to pay for your order on our website as follows:
- a compulsory deposit, debited on the day of confirmation of shipment of your order, corresponding to one third or one quarter of the order, to which are added charges corresponding to 1.45% of the total amount of the order for a 3-time payment and 2.2% for a 4-time payment (up to a maximum of €15 for a 3-time payment and €30 for a 4-time payment) ;
